Please join Buchanan for a CLE panel discussion titled "Shifting Your Paradigm: Making Deals in Mediation." The presentation, featuring Buchanan attorneys Jesse Diner, Jill Lashay, Thomas Thompson and Jaime Tuite, will take participants through the various stages of mediation from the perspectives of experienced mediators, litigators and a deal lawyer (appointed by the court), including:
- Setting the Stage: Why do the vast majority of cases settle? What are the ways the courts encourage early settlement?
- Mediation Defined: How does mediation differ from litigation, arbitration, and early neutral evaluation? What makes a good mediator? How are “wins” defined in mediation?
- Mediation Preparation: Identifying weaknesses, strengths, litigation budget, anticipating likely outcomes, determining the best timing and leverage points, and knowing the witnesses.
- Managing Client Expectations: What information should be shared with the mediator and opposing parties before the mediation? What information do you need for mediation? Who needs to be in the room for the mediation?
- Alternative Approaches: Understanding differing mediation styles and methods to get a "deal."
- Defining Success: How to avoid impasse? How to understand the business realities that may make or break the deal? What did you accomplish through the process
