As colleges and universities face growing scrutiny from federal regulators, they need to carefully navigate important national security risks and legal considerations. This includes understanding the Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR), and the economic sanctions administered by the Office of Foreign Assets Control (OFAC). These legal frameworks come into play in various ways, including when institutions:
 

  • hire foreign faculty and enroll graduate students;
  • participate in academic conferences abroad;
  • establish international research and cultural programs;
  • establish international campuses or university-administered study abroad programs; or,
  • manage compliance of faculty members’ international research profiles. 

To help institutions stay compliant, members of Buchanan’s higher education and national security teams will share best practices for Offices of General Counsel. They will emphasize the importance of adhering to these legal requirements, especially since violations can lead to serious civil and criminal consequences. Ultimately, while the stakes for compliance are high, the rewards of international collaboration for educational institutions, their researchers, and students are equally substantial.

Continuing Legal Education (CLE) credit (1.0 general credit) is approved for California, New Jersey, New York, Pennsylvania and West Virginia. Credit for all other states is available upon request pending approval.
