Kristi A. Davidson, Shareholder in the firm’s Litigation Section, recently published an article, “Legally Speaking: When a Celebrity’s Good Review is a Bad Thing” in HFN Magazine. The article describes the potential risks that a consumer products company may face when a celebrity endorses its products. For example, if a celebrity raves about a product on Twitter and the company retweets it without permission, the company could quickly be in trouble in a private civil suit or Federal Trade Commission enforcement. Similarly, if a company posts a link to an article that shows a photo of a celebrity with the company’s product, the company may be required to pay for the unauthorized use of the image. Davidson emphasizes the importance of using caution with celebrity endorsements, particularly with social media.
