Salvatore Rotella Jr., shareholder in the firm’s Healthcare section and Alexis Langella, shareholder in the firm’s Litigation section, are presenting to members of the National Association of Therapeutic Schools and Programs for a session entitled, “Responding to Inquiries and Investigations Regarding Resident Safety.”

Learning Objectives Include:

  • Identify the types of documents, information, and access that should be provided in response to resident safety inquiries, while also identifying information that is outside the scope of such an inquiry.  Considerations for patient specific inquiry v. routine monitoring requests. 
  • Understand what constitutes proper authority for the release of medical records, including complicating factors of minor's medical records.
  • Know the basics of conducting an internal compliance investigation - when, why, and by whom it should be conducted. Identification of the benefits of conducting internal investigations, potential pitfalls, and improvement/training opportunities.
  • Learn the potential impact of resident safety issues on a facility, including on its relationship with oversight bodies, referral sources, and 3rd party payors, as well as on public relations more generally.
