Stuart P. Slotnick, managing shareholder of Buchanan Ingersoll & Rooney's New York office and vice chair of the firm's Business Litigation and Trial Practice group, contributed to a July 16, 2010, Law360 article titled, "5 Ways To Stave Off Punitive Damages."

As part of the article, Law360 talked to attorneys and law professors to find out how defense attorneys can best protect their clients against punitive damages. Slotnick was among the professionals asked to weigh in; his tip — "Control the message."

As noted in the article, "Slotnick said it is imperative for witnesses to stay on message. Those involved in the alleged conduct have frequently left the company or the company has often been acquired by another corporation since the alleged incident, he said."

"Your witnesses need to be likable and be the face of the company," Slotnick said. "They need to say that the company who performed the bad acts is not the company of today."
