Michael L. Dever, Shareholder in Buchanan Ingersoll & Rooney’s Intellectual Property Section, was recently quoted about the America Invents Act (AIA) in an article that appeared in The Legal Intelligencer and Corporate Counsel. The final components of the AIA became effective on March 16, when the country moved from a first-to-invent to a first-to-file patent system.

As Dever explained, the USPTO had been preparing for a "huge spike" in application filings on March 15. Dever also explained that the USPTO has done a good job of reducing its recent backlog.

Dever further explained that post-grant review proceedings, which allows challenges to patent grants within nine months of their issue date, will likely start to arise later in the year.
