In the October 2014 issue of the American Health Law Association’s Long Term Care Services Monthly Newsletter, members of Buchanan’s health care section Bill Conaboy and Alexis Langella penned an article titled, “Dealing with Known or Suspected Whistleblowers in Internal Investigations: Status of the Law Challenges Facilities Face, and Strategies for Managing Risk.”

The article discusses how health care providers should deal with an employee who is a known or suspected whistleblower. In addition to explaining the evolution of the Federal False Claims Act anti-retaliation provision, the article also provides tips to help avoid liability under that provision.
