Kristi A. Davidson recently authored a chapter in a Thompson Reuters publication titled, "New Developments in Evidentiary Law in New York." Davidon's chapter, “A Game of Tug of War: Balancing Broad Discovery Against Burdensome ESI,” compares and contrasts the very active New York federal bench and its e-discovery rulings with the less clear and often contradicting New York state practices. The chapter tracks the evolution of federal and state law following the seminal Zubulake decisions, examines ensuing rule changes and considers the bar’s practical responses to increasing e-discovery expense (including predictive coding). Kristi authored a chapter for the 2012 edition of the same publication titled, “The Internet Age: Overcoming Hurdles to the Use of Social Media and Other Electronic Evidence at Trial.”
