Paul J. Greco, Counsel in Buchanan Ingersoll & Rooney’s Litigation Section, recently published an article, “Medical Device Sales Poaching: Should You Be Concerned?” on the Medical Decide and Diagnostic Industry website. “Poaching” refers to the lateral movement of sales representatives among competitors. Because sales representatives in the medical device industry have strong relationships with the surgeons they serve, these lateral movements can sometimes involve litigation, particularly if a non-compete or non-solicit agreement is in place.
