In an Investment News article published December 11, 2012, Buchanan Ingersoll & Rooney Litigation Shareholder Joseph A. Dougherty discussed the non-solicitation language included the employment contracts of Edward Jones brokers.

According to the article, “the partnership tells brokers it’s their fault if a client contacts them once brokers leave, regardless of who is making the call.”

As Dougherty explained, Edward Jones “is trying to enhance the contract’s language to address past successful arguments against the enforcement of non-solicitation agreements in temporary restraining orders versus brokers who have left.”
