Kristi A. Davidson, a shareholder in the firm’s Litigation Section, recently published an article, “The Star Treatment” in HFN Magazine. The article describes the necessary steps that a consumer products company should take to avoid litigation down the road when drawing up endorsement agreements. Davidson emphasizes the importance of setting the parameters of the endorsement to include the product(s) being endorsed, geographical reach, as well as the amount and form of compensation. For example, defining and outline the different fees that may surface such as fixed fees, appearance fees or other expenses and who will be responsible for those costs. She also stresses that the trick with celebrity endorsements is to make things as explicit as humanly possible.
