Heather Alleva, associate in Buchanan's Healthcare section was quoted in a Part B News article "Be careful with HIPAA under OCR’s ‘good faith’ telehealth provision; you may face future risk" on the topic of expanded use of telehealth during COVID-19 in accordance with HIPAA.
“Give the patient the risks and benefits of the platform,” says Heather R. Alleva, an associate with the law firm Buchanan Ingersoll & Rooney PC in Philadelphia. For example, you might say: “One disadvantage is that I cannot conduct a physical exam. Another is that there’s an opportunity for someone to capture our transmission, but that’s rare,” Alleva suggests. “Allow the patient to ask questions about the technology. Get their concerns.”
