Under the pressure of volatile land owners, urgent time constraints and tenacious opposing counsel, Matt Burger and Dan Garfinkel obtained five emergency injunctions for a Fortune 200 Company. The issue in each of the cases was the surface owners’ refusal to permit the client’s contractors from performing seismic testing operations used to locate oil and gas in the subsurface estate. Though the leases by which the client holds the oil and gas rights at issue did not specifically provide for seismic testing, Matt and Dan successfully argued that the client’s right to operate upon the properties for oil and gas necessarily includes the right to explore for that same oil and gas via seismic testing. As a result of Matt and Dan’s efforts, the seismic testing operations proceeded as scheduled and should yield valuable data regarding the most advantageous locations to drill for oil and gas.
