A recent advisory written by shareholder B. Lafe Metz and associate Tyler S. Dischinger of Buchanan Ingersoll & Rooney’s Real Estate section was published in Law360’s Pennsylvania and Real Estate Expert Analysis section. The article, “No Timber Rights Assurance for Pa. Property Buyers” describes the impact of the recent decision in Zitney v. Appalachian Timber Products Inc. The Zitneys, Pennsylvania property buyers, were unaware of an existing timber contract on their land when a timber company began timbering. The court permitted the timber company to continue timbering on their land despite the fact that the Zitneys were unaware of the existing, unrecorded timber contract.
