David B. Fawcett
Shareholder
David Fawcett has successfully pursued fraud and punitive damage claims arising out of business transactions. He has also obtained many injunctions of various kinds on an emergency basis. David has obtained several jury verdicts, which rank among the largest in the country. He has handled scores of cases involving trade secrets and restrictive covenants.
David is a fellow in the American College of Trial Lawyers and has been listed in Best Lawyers in America since 2001. He has also been repeatedly selected to the Pennsylvania Super Lawyers® list, as well as the Corporate Counsel Super Lawyers® list. David previously served as an elected official in Allegheny County and has extensive community involvement with civic and charitable organizations.
David's notable engagements include:
- Winning a fraud claim on behalf of a steel producer and collecting a jury verdict in an amount exceeding $267 million, including $100 million in punitive damages.
- Representing a small coal mining company in a tortious interference claim and winning a jury verdict in an amount exceeding $50 million, including $6 million in punitive damages.
- Representing a client in the United States Supreme Court in a landmark case involving the issue of when a judge must recuse himself from a case involving his political supporters.
- Protecting companies' confidential and trade secret information by obtaining injunctions to prevent former employees' and competitors' misuse of that information.
- Advising shareholders in closely held companies to avoid overreaching by majority shareholders.
- Winning and collecting a $7.2 million jury verdict rendered in the Circuit Court of Buchanan County, Virginia.
- Successfully obtaining a mandatory injunction on behalf of a steel producer requiring its raw materials supplier to ship product.
