Buchanan Ingersoll & Rooney patent litigators Philip L. Hirschhorn and S. Lloyd Smith recently obtained a Federal Circuit Court of Appeals ruling for client Tetra Pak affirming their prior victory on summary judgment at the U.S. District Court for the Western District of Wisconsin, reported Law360.

In an opinion authored by Chief Judge Rader, the Federal Circuit agreed with Tetra Pak’s arguments on all issues concerning both infringement and validity, reported the article titled, “Fed. Circ. Affirms Tetra Pak’s Cheese Vat Patent Win.”

The Federal Circuit reversed on the sole issue that had been previously decided adversely to Tetra Pak, granting a more favorable claim construction and finding literal infringement instead of infringement under the doctrine of equivalence as awarded by the District Court. Tetra Pak is the world's leading food processing and packaging solutions company.
