Law360 recently published an article titled, “The Successful Litigator’s Settlement Playbook.” The article features tips and tricks from litigators on how to land settlements that will result in a happy client.

Buchanan Ingersoll & Rooney’s Litigation Section Co-chair Gretchen L. Jankowski offered her insight to the publication. “Early on, when the other side is asking for an outrageous sum, ask them to substantiate it. That will get them off that outrageous demand.”

Jankowski added that you should bring a term sheet when it comes to working out an agreement – “one that resolves questions like confidentiality and whether a settlement payment will come in one installation or multiple rounds.”
