Law360 Continues to Cover Firm Client XTO’s Dispute with the U.S. Department of Justice

Firm client XTO Energy Inc., accused by the commonwealth of spilling toxic wastewater from a gas well site in 2013, was successful in asking a Pennsylvania federal judge to transfer its lawsuit to the courtroom where the company is pursuing documents from a grand jury inquiry, noted Law360. U.S. District Judge Christopher C. Conner approved XTO’s request to move its suit from a Harrisburg federal court to one in Wilkes Barre, Pa. XTO had filed an Administrative Procedure Act case, which accused the DOJ and a U.S. attorney of acting unjustly by declining to respond to a subpoena to produce documents related to a federal investigation of the incident. The company says these documents might clear it of the criminal charges in the commonwealth. It also filed a motion to disclose grand jury matters on Jan. 14 in the Middle District of Pennsylvania. XTO is represented by shareholder James M. Becker and associate John J. Powell.
