Kelly Ann Toy concentrates her practice in secured and unsecured commercial lending transactions, real estate and construction finance and other credit accommodations, representing banks, asset-based lenders, and other types of financial institutions. She also represents corporate borrowers in a variety of financing and secured transactions, including acquisition finance, multi-state mortgage finance, and matters before industrial development agencies.
Kelly's experience includes cross-border lending and other transactions. She assists both lenders and borrowers with working out problem loans, collateral dispositions, and restructuring loan transactions, and she is experienced in structured finance transactions and bankruptcy-related matters.
Additionally, Kelly is member of the Financial Institutions Asset Acquisition Group, which represents national and international financial institutions in connection with acquisitions and sales of financial assets, including loan portfolios and bank branches. Kelly was one of the members of the Financial Institutions Asset Acquisition Group that recently represented a group of banks (including a European bank and several domestic banks) in the largest branch sale in the United States.
