Ivan J. Punchatz is a health care attorney who has practiced in health care law for more than 30 years and formerly was deputy attorney general for New Jersey. He has argued successfully before the New Jersey Supreme Court in cases involving Medicaid fraud and abuse penalties, rule-making procedures and health benefits based on disability.
Ivan serves as head of Buchanan's New Jersey Health Care Group.
His clients include hospitals, long-term care facilities, managed care organizations and state health care trade associations.
While serving as deputy attorney general for New Jersey, Ivan represented the state Medicaid program, state psychiatric hospitals and long-term care facilities.
On behalf of clients, Ivan has won appellate court decisions increasing reimbursement to six hospitals by several million dollars and reducing a hospital-specific tax for 16 hospitals. He has obtained or defeated certificates of need despite vigorous opposition in administrative and judicial forums for his clients.
Ivan also increased nursing home Medicaid reimbursement through negotiations and/or hearings and successfully resisted nursing home licensure and certification sanctions.
Ivan successfully represented the New Jersey Joint Committee on Legislative Ethics in the first prosecution of a legislator for inappropriate activity. He regularly counsels clients on corporate compliance with the myriad governing regulations in regard to repayment or other sanctions.
Ivan served on the Assisted Living Task Force appointed by the New Jersey Housing and Mortgage Financing Agency. He has represented many developers and originators of assisted living and nursing facilities in the development and financing of projects and continues in advising his clients on day to day operations.
Active on a large scale in the health care field, Ivan lectures widely to professionals on many topics. He assists his clients to position themselves for the future, while meeting the legal issues they face in the present, particularly corporate structure, governance and financial issues in the shifting health care industry.
