Buchanan has extensive experience in using state and federal court receiverships as an efficient and cost-effective alternative to bankruptcy or foreclosure. Our receivership experience, which extends both to single-asset real estate companies and operating companies, includes the ability to liquidate collateral in an orderly fashion thereby maximizing return for the lender. The costs and expenses of maintaining a receivership estate are typically significantly lower than a chapter 11 and offer the benefits of speed and flexibility.

We represent special servicers in connection with defaulted securitized loans. Our team understands the goals of special servicers in workouts and the limitations faced in workouts and restructurings. Buchanan represents several of the largest special servicers in matters throughout the country. In addition, we represent lenders and special servicers in connection with large-scale mortgage-fraud relating to securitized loan pools. We have experience with creditors and lenders who have been defrauded and the rights of creditors with respect to criminal forfeiture proceedings. We know the federal government employees with primary responsibility over forfeiture.
