Law360 reported in an article that Buchanan Ingersoll & Rooney IP attorney Lynn J. Alstadt urged the International Trade Commission (ITC) to vote against initiating an investigation "into the alleged violation of a fabric-making patent." Alstadt wrote to the ITC in response to a Federal Register Notice seeking comments about a complaint from a domestic bed linen supplier, arguing that the products were made using the process described by the claims.

"The declaration merely guesses at what manufacturing methods may be utilized by third parties without any personal knowledge or other basis for making such guesses," Alstadt wrote in his response.
