Buchanan Ingersoll & Rooney Litigation Shareholder H. Marc Tepper was noted in a Law360 article regarding a favorable settlement reached by the U.S. Virgin Islands in the Tutu Wellfield Superfund site.

The U.S. government sought court approval for the consent decree, calling the agreement “fair, reasonable, consistent with the [Comprehensive Environmental Response, Compensation and Liability Act] and in the public interest.”

The Virgin Islands’ government will take charge of the site in April 2013, a year earlier than the original Superfund contract dictated.

In preparation for next year’s handover, environmental officials from the Virgin Islands “have been shadowing U.S. officials as they perform remedial activities, including participating in a seven-day groundwater sampling event and a month-long training program that will cover facility operations and maintenance.”
