Legal strategies for competitive businesses.
As new interpretations and heightened enforcement continue to change the way companies compete for business, navigating the laws that govern competition is a challenge that requires sophisticated strategy and applied experience. Our Antitrust and Trade Regulation team provides clients with trusted counsel on the full spectrum of competition law — from bet-the-company litigation and sophisticated merger and acquisition review, to strategic counseling on day-to-day competition questions and assistance in civil and criminal government investigations.
Recognized leaders in antitrust law.
Our antitrust lawyers are recognized by inclusion in the American College of Trial Lawyers, the International Academy of Trial Lawyers, Best Lawyers in America, Chambers' Guide to Leading Business Lawyers and Super Lawyers®. We are regularly asked to serve as key speakers and panelists for competition law programs, and we frequently author advisories and articles and teach classes on competition-related issues that impact businesses around the world.
We regularly handle complex antitrust cases with damage claims in the hundreds of millions, or billions of dollars; we navigate the process of mergers and acquisitions; and we provide counseling on trade regulation compliance related to competitive business strategies and government and regulatory investigations. We have litigated or otherwise resolved matters dealing with cartel behavior, such as price-fixing and market allocations, as well as group boycotts, vertical restraints and distribution agreements, exclusive dealing arrangements and other antitrust and trade regulation issues. We often represent foreign companies in their US antitrust litigation matters and have helped them successfully navigate federal and state antitrust laws. Our experience spans specialized contexts and regulated industries and includes handling issues at the intersection of antitrust and intellectual property.
Aggressive but strategic trial lawyers.
Named in 2010 by Law360 for its "Antitrust Case of the Decade," Buchanan Ingersoll & Rooney's antitrust trial lawyers won a case that dramatically changed litigation strategies used by plaintiffs and defendants in class certification disputes in antitrust cases. Our approach to class-action and individual litigant antitrust cases is aggressive but strategic. Our trial lawyers tried one of the largest antitrust class action cases ever to face a jury, obtaining judgment in their client's favor on plaintiffs' multi-billion dollar damage claim at the close of the class plaintiffs' eleven week case. We won one of the largest jury verdicts in the country in a federal antitrust case involving the electronic surveillance industry, and we have litigated national class-action conspiracy lawsuits brought by direct and indirect purchasers as well as cases involving sophisticated antitrust issues like immunity and those that surface where antitrust and patent law meet. We are also experienced at litigating claims by terminated dealers, distributors and sales agents.
Effective mergers and acquisitions team.
In the past five years alone, we have represented hundreds of public and private companies in mergers, acquisitions and joint ventures with an aggregate value of billions of dollars. We often become an integral part of our clients' businesses, allowing us in-depth familiarity with their business objectives. Our experience with federal and state antitrust regulators, as well as our ability to marshal talent from our colleagues in other key practice areas, contribute to our successful completion of the most complex mergers and acquisitions, collaborations and industry consolidations. We proudly point to consummated transactions, both with and without federal or state consent orders, as we are skilled in getting to close.
Trusted counsel for competition issues.
We provide day-to-day counseling to assist clients avoid competition issues as they position their products and services for market growth, spanning retail and health care to high tech and heavy industry. We regularly advise our clients on issues related to pricing, distribution, intellectual property and other compliance concerns that frequently arise in the course of doing business. We use an established compliance program customized for each client. We have counseled trade associations and their members on how to ensure compliance with antitrust laws.
Highly experienced in government investigations.
Our multidisciplinary team represents clients before the United States Department of Justice (DOJ), the Federal Trade Commission (FTC), state attorneys general, and other federal and state regulatory agencies. In our practice, we counsel individuals and companies who are subpoenaed as third-party witnesses; we also counsel clients with their own business interest in such investigations. In conjunction with our White-Collar Defense and Investigations attorneys, we handle both the civil and criminal aspects of government investigations. We understand the relationship between investigations and criminal or civil proceedings and have represented companies in indictments and civil complaints resulting from government investigations as well as in the defense of antitrust class actions that arose out of government investigations both in the US and abroad.
