Annemarie McGavin concentrates her practice in employee benefits, particularly qualified plans, non-qualified deferred compensation plans and tax-sheltered annuity plans. She also has experience with health and welfare plans.
In her practice, Annemarie has assisted clients in the design, development and administration of their employee benefit plans. She has drafted plan documents meeting the diverse needs of clients, including plans that have received IRS approval. As part of her practice, she has worked as employee benefits counsel in mergers and acquisitions, advising clients of the impact of these transactions on employees and benefit plans. Additionally, she has advised clients regarding the business opportunities created with the implementation of an ESOP. She also has counseled fiduciaries, including plan sponsors and bankruptcy trustees, regarding the special issues that arise when a plan sponsor enters into bankruptcy.
Annemarie has performed internal compliance audits of employee benefit plans and has counseled clients regarding methods for correcting document, operational and fiduciary violations. She has successfully obtained compliance statements on behalf of clients participating in IRS and DOL correction programs. Additionally, she has assisted clients in responding to government inquiries, and guided clients during audits conducted by the IRS and DOL.
